1. Objective
This Statement aims to define the data protection and privacy principles of the Patchaway application
(Operator: Manumath UG (haftungsbeschränkt) | Rupert-Mayer-Str. 44 | 81379 München | Deutschland / Germany (hereinafter: Operator) and the data protection and privacy policy of the Operator).

This Statement further aims to ensure that the rights of the users of the services provided by the Operator are respected (especially in terms of privacy) during the automatic or manual processing of their personal data (data protection).

3. Processed personal data
3.1. In app purchase (hereinafter IAP):
During the IAP process, automatically generated data is processed by us, although: In-app purchases are purchased from and billed by Apple iTunes, not by Manumath. These purchases are subject to the terms and conditions of Apple iTunes. Manumath does not have access to Apple iTunes account data or to the transactions itself. The data content is anonymized, and the content is determined by Apple iTunes.
The application collects anonymized usage statistics, as the user uses the app. This date does not include any Internet Protocol ("IP") address, device identifiers, device information, or user specific information. The purpose of this data collection is to analyze, develop, update and improve our application.

3.2. The data recorded automatically during the operation of the system are the data on the user's computer that are generated during the use of the services and are automatically recorded by the data controller's system as a result of technical processes. The system may automatically record the automatically recorded data without any specific consent or act of the User when the User uses the app. Data may only be accessed by the data controller, unless otherwise specified by law.

4. Objective, method and legal grounds for data processing:
4.1. Data may only be processed on the basis of an informed statement issued voluntarily by the User of the App; the statement shall contain the user's express consent to the processing of the data that have been provided during the use of the App in accordance with the data protection statement and privacy policy.
The legal ground for data processing is the consent of the data subject. The User gives his/her consent to the data processing by using the App, or voluntarily providing the data in question. In the case of minors, we assume that data provision has been approved by the parent or legal guardian.
4.2. The objective of the data processing is the provision of services available in the App. The Operator may store the data provided by the User only for a specific purpose, in order to ensure the completion of the services and compliance with the terms of an eventually concluded future contract.
4.3. The purpose of automatically recorded data is the production of statistics, the technical development of the IT system and the protection of the Users' and Operator's rights.
4.4. The data controller may not use the provided personal data for any other purposes. Unless otherwise stipulated by law, personal data may only be disclosed to third parties or authorities with the prior express consent of the User. In case of doubt, it shall be presumed that the User has not given his/her consent.
4.5. The data controller does not verify the authenticity of the provided personal data. The person providing the data shall assume sole liability for the accuracy of the data provided. The User agrees to be the sole person using the services with the data provided.
4.6. As a general principle, we state that in each case we request data from our Users, they may decide on the provision of data voluntarily, after reading and interpreting the necessary information. However, the User's refusal to provide us with his/her personal data may lead to the User not being able to use the services which are subject to the provision of personal data.

5. Persons to whom data may be disclosed, data transfer, data processing
5.1. Data may primarily be disclosed to the Operator and its internal colleagues; however, they may not publish or disclose the data to any third party.
5.2. In relation to the operation of the IT-system that serves as a basis for the App, the completion of orders and accounting, the Operator may employ a data processor (i.e. system operator, accountant). The Operator shall select these external actors carefully, but does not assume liability for their data processing practices.

5.3. Furthermore, the User's personal data may only be transferred in the cases provided for by law or with the consent of the User.

6. User rights and the enforcement of rights
6.1. The User may request information concerning its personal data processed by the Operator
6.2. Upon the User's request, the Operator shall provide information on the User's data processed by the Operator, the purpose of the data processing, legal grounds, duration, the persons to whom the data were or will be disclosed, and the purpose for which they have received such data. The Operator shall provide the information in writing within 30 days after the request has been submitted. The information is free of charge if the person requesting the information has not submitted an information request concerning the same data in the same year. In other cases, expenses may be charged.

In relation to any questions or remarks concerning data processing, Users may contact the employee of the Operator via the contacts specified in Article 6.3.
6.4. In the event of a complaint against the data processing practice, Users may enforce their rights in a court action or may contact:

7. Miscellaneous
7.1. The Operator's system records data on the activity of the User; such data are related to the use of the App.
7.2. If the Operator intends to use the provided data for a purpose other than data recording, it shall inform the Users, shall obtain their prior express consent, and shall provide an option for them to refuse data processing.
7.3. The Operator undertakes to ensure data security, takes technical measures which ensure that the recorded, stored and processed data are protected, and uses its best endeavours to prevent the destruction, unauthorised use and unauthorised modification of such data. The Operator further undertakes to inform all third parties to whom it may transfer or transmit the data of such obligations.
7.4. The Operator reserves the right to unilaterally modify this Statement with prior notice made available on its website. After the effective date of the modification, Users may accept the terms of the modified Statement tacitly, by continuing to use the services.
Users shall be informed of the modifications via the website at least 15 days prior to the effective date.
7.5. During the use of the App, Users also access services provided by third parties (i.e. purchasing an in app product). Such data processing is subject to the privacy policy of the third parties, such data are not processed by the Operator, and therefore, the Operator does not assume liability for such data processing.
